Shqyrtimi i kërkesës për ndihmë juridike dytësore nga gjykata
Gjykata shqyrton kërkesën për ndihmën juridike dytësore në përputhje me parashikimet në legjislacionin procedural dhe, për aq sa është e mundur, me dispozitat e këtij ligji.
Vendimi në lidhje me kërkesën për ndihmë juridike dytësore merret nga gjykata kompetente:
brenda 5 ditëve nga data e regjistrimit të kërkesës, kur kërkesa paraqitet përpara fillimit të procesit gjyqësor;
gjatë veprimeve paraprake ose në seancën përgatitore përpara se të caktohet seanca gjyqësore, kur kërkesa për ndihmë juridike është paraqitur bashkë me kërkesë-padinë;
sipas parashikimeve të legjislacionit procedural dhe dispozitave të këtij ligji, kur kërkesa paraqitet gjatë shqyrtimit gjyqësor.
Në rastet kur kërkuesi deklaron pamundësinë për sigurimin e dokumentacionit, si dhe në çdo rast tjetër kur gjykata çmon se korrigjimi ose plotësimi i kërkesës mund të bëhet shkak për vonesa, të cilat cenojnë thelbin e të drejtave të kërkuesit, gjykata mund të urdhërojë dorëzimin e dokumentacionit të nevojshëm nga organet e administratës shtetërore që e disponojnë atë. Në këto raste kërkesa për ndihmë juridike dytësore quhet e paraqitur në përfundimin e afatit të vendosur nga gjykata për paraqitjen e dokumentacionit plotësues nga organet e administratës shtetërore.
Gjykata, në përputhje me parashikimet e këtij ligji dhe parashikimet në legjislacionin procedural, pas shqyrtimit të kërkesës vendos:
- pranimin e kërkesës për dhënien e ndihmës juridike dytësore;
- rrëzimin e kërkesës për dhënien e ndihmës juridike dytësore.
5. Kërkesa për ndihmë juridike dytësore rrëzohet vetëm në rastet kur:
nuk përmbushen kushtet e parashikuara në nenet 11 ose 12 të këtij ligji;
është dukshëm abuzive ose haptazi e pabazuar.
Vendimi për pranimin ose rrëzimin e kërkesës për ndihmë juridike dytësore jepet i arsyetuar.
Kundër vendimit të gjykatës për rrëzimin e kërkesës për ndihmën juridike dytësore mund të bëhet ankim i veçantë. Ankimi i vendimit nuk pengon vazhdimin e shqyrtimit të çështjes. Ankimi bëhet sipas formularit tip të miratuar nga Ministri i Drejtësisë, i cili i jepet kërkuesit së bashku me vendimin për rrëzimin e kërkesës.
Gjykata e apelit shqyrton çështjen në dhomë këshillimi dhe merr vendim brenda 15 ditëve nga regjistrimi i çështjes. Kundër këtij vendimi nuk lejohet rekurs në Gjykatë të Lartë.
Drejtoria e Ndihmës Juridike Falas mund të ankimojë vendimin e gjykatës për pranimin e kërkesës për ndihmë juridike dytësore, nëse pretendon se kjo kërkesë është dukshëm abuzive ose haptazi e pabazuar. Në këtë rast zbatohen afatet dhe rregullat për ankimin e vendimeve përfundimtare, sipas dispozitave të legjislacionit procedural. Kundër vendimit të gjykatës së apelit nuk lejohet rekurs në Gjykatë të Lartë.
Kjo është një dispzitë me natyrë proceduriale, e cila përcakton rregullat e shqyrtimit të kërkesës për ndihmë juridike dytësore nga gjykata dhe vendimmarrjen përkatëse për këtë kërkesë.
Vendimi në lidhje me kërkesën për ndihmë juridike dytësore merret nga gjykata në këto tre raste dhe afate:
- brenda 5 ditëve kur kërkesa paraqitet përpara fillimit të procesit gjyqësor;
- gjatë veprimeve paraprake ose në seancën përgatitore para se të caktohet seanca gjyqësore, kur kërkesa për ndihmë juridike është paraqitur bashkë me kërkesë-padinë;
- sipas parashikimeve të legjislacionit procedural, pra në formën e një kërkesë të vecantë kur kërkesa paraqitet gjatë shqyrtimit gjyqësor.
Në çështjen Croissant v Germany, Gjykata Europiane e të Drejtave të Njeriut ka vendosur se: “Duke marrë në konsideratë vendimet e fundit të Kryetarit të Gjykatës së Apelit të Shtutgartit dhe vendimin e gjykates së shkallës së parë, nuk ka dyshim se është ankimuesi që duhet të paraqesë se ai nuk ka mundësitë paguajë pagesën e plotë, dhe atëherë legjisacioni përkatëse dhe praktika duhet të zbatohen. Në këtë aspekt Gjykata konsideron se është e pranueshme sipas Konventës, se barra e provës për të provuar mungesën e mjeteve të mjaftueshme duhet të jetë tek personi që bën kërkesën.”
Nga ana tjetër, në çështjen Pakelli v Gjermanisë, Gjykata Europiane për të Drejtat e Njeriut ka përcaktuar gjithashtu edhe rolin e gjykatës dhe thellësinë e shqyrtimit gjyqësor në rast se para saj paraqitet një kërkesë për ndihme juridike dytësore. Sipas Gjykatës së Strasburgut “nuk është e nevojshme të provohet “përtej çdo dyshimi” se aplikanti është i varfër. Mjafton që të provohet “mungesa e mjeteve” ne “mungesë të të dhënave të tjera që të vërtetojnë të kundërtën”.
Kundër vendimit të gjykatës për rrëzimin e kërkesës për ndihmën juridike dytësore mund të bëhet ankim i veçantë dhe ankimi i vendimit nuk pengon vazhdimin e shqyrtimit të çështjes. Gjykata e Apelit shqyrton çështjen në dhomë këshillimi dhe merr vendim brenda 15 ditëve nga regjistrimi i çështjes. Ndaj këtij vendimi nuk lejohet të bëhet rekurs në Gjykatë të Lartë.
Në rast se Gjykata e Apelit rrëzon kërkesën për ndihmë juridike dytësore të paraqitur para saj, atëherë ndaj këtij vendimi nuk mund të bëhet ankim i veçantë në Gjykatën e Lartë, por mund të bëhet rekurs, së bashku me vendimin përfundimar të Gjykatës së Apelit.
Sipas pikës 9 të këtij neni Drejtoria e Ndihmës Juridike Falas mund të ankimojë vendimin e gjykatës për pranimin e kërkesës për ndihmë juridike dytësore, nëse pretendon se kërkesa e pranuar nga gjykata është dukshëm abuzive ose haptazi e pabazuar. Nga formulimi i kësaj dispozitë rezulton se Drejtoria mund të ankimojë vetëm vendimin e gjykatës së shkallës parë që ka miratuar kërkesën për ndihmën jurudke dytësore, por jo vendimin e Gjykatës së Apelit apo të Gjykatës së Lartë kur para saj paraqiten kërkesa për ndihmë juridike dytësore. Nga ana tjetër, mbetet të shihet zbatimi i kësaj dispozite në praktikë sepse Drejtoria e Ndihmës Juridike Falas në Ministrinë e Drejtësisë, nuk është palë në procesin gjyqësor që zhvillohet për miratimin ose jo të kërkesës së paraqitur. Ajo nuk është as në cilësinë e personit të tretë në këtë gjykim, ndaj në kuptim të legjislacionit procedurial do të shihet në praktikë dhe në jurisprudencë se si do të zbatohet pika 9 e këtij neni.

Paid for the three day offer and with the confirmation of the subscription, got two mails from hornycontacts.com and loveaholics.com asking me to confirm my email. Didn’t pay attention and deleted them.
I immediately canceled the subscription in flirt.com without any issue and on the last day it changed to a standard membership so since it was bs site, cancelled the account as well.
So I was happy and watching a movie when I got an sms from my card provider telling me that I got a 71.78 euros charge from fry frtlsp.com. Never heard of them, so I called my card provider and cancelled my card and will request the return of the money as well.
Then I realized that maybe these two websites also by some miracle signed me up to a paid subscription... so I logged in... had to recover the passwords because they were not the one I used in flirt.com... and surprise, loveaholics.com did signed me up for a paid subscription without me being aware (pretty sure that somewhere during the signing process in flirt there was something checked and didn’t pay attention.). So I had to cancel subscription and account in these two other sites.
So, sorry for the long post but in summary.... do not use flirt.com at all!!!
Yes, FLIRT.COM it is a scamming website. It sign you on multiple websites like askme4date.com . It bombard you with emails that you receive messages, and you need to pay to see them. After you pay you see the messages. All messages are from BOTS. No real person.
It's subscribing to automatic renewal and it's hard to cancel renewal. They push you to a complicated scheme. I'm not even sure the renewal canceling works. After
