Rimbursimi në rastin e dhënies së informacioneve të rreme ose të pavërteta

Neni: 
32

Kërkuesi që ka përfituar ndihmë juridike dytësore dhe/ose përjashtim nga tarifat gjyqësore dhe shpenzimet gjyqësore, duke paraqitur të dhëna të pavërteta ose të pasakta, është i detyruar të rimbursojë shpenzimet për avokatin që ka dhënë shërbimet e ndihmës juridike dytësore dhe/ose shpenzimet gjyqësore. Pavarësisht nga rimbursimi i këtyre shpenzimeve, Drejtoria e Ndihmës Juridike Falas bën kallëzim penal, kur konstaton se ka elemente të veprës penale. 

2.  Në rast se kërkesa për ndihmë juridike dytësore dhe/ose përjashtim nga tarifat gjyqësore dhe shpenzimet gjyqësore, që përmban informacione të rreme ose të pavërteta, është dorëzuar nga një person tjetër i ndryshëm nga personi të cilit i është pranuar kërkesa për ndihmë juridike dytësore dhe/ose përjashtimi nga tarifat gjyqësore dhe shpenzimet gjyqësore, dorëzuesi dhe përfituesi janë solidarisht përgjegjës për  rimbursimin e shpenzimeve të përcaktuara në pikën 1 të këtij neni. 

3.  Rimbursimi i shpenzimeve, sipas pikave 1 dhe 2, të këtij neni, bëhet sipas kërkesës së Drejtorisë së Ndihmës Juridike Falas. Në rast të mosekzekutimit vullnetar, Drejtoria e Ndihmës Juridike Falas paraqet kërkesëpadi në gjykatë, duke kërkuar kthimin e shumës në përputhje me legjislacionin në fuqi.  

I gjithë informacioni që paraqet dhe depoziton personi që përfiton ndihmën juridike dytësore dhe/ose përjashtimin nga tarifat apo shpenzimet gjyqësore nëpërmjet formularëve të aplikimit për çdo rast, duhet të jetë  i vertete dhe i sakte.  Dhenia e nje informacioni, deklarimi te pasakte apo te pavertete apo dhenia e dokumentave false përbën shkak të ligjshëm që personi, sipas përcaktimeve të bëra në këtë nen, të detyrohet dhe të realizojë rimburisimin e të gjithë fondeve të përfituara në kuptim të këtij ligji, dhe nga ana tjetër, të mbajë edhe përgjegjësi penale për shkak se formularët dhe deklarimet që nënshkruan janë akte zyrtare dhe përfituesi është paralajmëruar me shkrim paraprakisht për detyrimin e vërtetësisë së informacionit që jep.

Në ato raste kur aplikimi për ndihmën juridike është bërë jo nga vetë personi që e përfiton atë, por nga subjekte që parashikohen nga neni 19 i këtij ligji, ateherë edhe këta persona janë përgjegjës  solidarë për rimburisimin e ndihmës së përfituar padrejtësisht. Drejtoria Juridike e Ndihmës Juridike Falas, në emër të shtetit, është në statusin e kreditorit që kërkon pagimin e borxhit nga çdo debitor. Detyrimi në këtë rast për rimbursimin është i përcaktueshëm sipas përcaktimit në ligj. Përgjegjësia solidare nënkupton të drejtën e kreditorit {Drejtoria e Ndihmës Juridike Falas} të kërkojë përmbushjen e detyrimit në tërësi, pavarësisht nga shkalla e pjesëmarrjes në shkaktimin e dëmit, nga cilido nga debitorët (personi që ka përfituar padrejtësisht ndihmën juridike, dhe nëse është rasti, edhe personi që e kanë kërkuar atë për llogari të tij}.
