Objekti i ligjit

Neni:

Ky ligj përcakton format, kushtet, procedurën dhe rregullat për organizimin dhe administrimin e ndihmës juridike të garantuar nga shteti, me qëllim mbrojtjen e të drejtave themelore të individit dhe të interesave të ligjshëm të tij.

Në përmbajtjen e Ligjit nr. 111/2017 fokusohen format, kushtet, procedurat dhe rregullat për organizimin dhe administrimin e ndihmës juridike, në funksion të mbrojtjes jo vetëm të të drejtave

themelore të individit dhe të interesave të ligjshme të tij që burojnë nga Kushtetuta e Shqipërisë, Konventa Evropiane e të Drejtave të Njeriut[1] dhe jurisprudenca e GJEDNJ, akte të tjera ndërkombëtare të ratifikuara nga Republika e Shqipërisë, kodet e procedurave, ligjet, etj., por, edhe në interes të drejtësisë.

Nevoja për një ligj me këtë objekt është rrjedhojë edhe e kërkesave përkatëse kushtetuese dhe ligjore për investimin e shtetit për një sistem efektiv të ndihmës juridike, të përcaktuara këto edhe në vendime të Gjykatës Kushtetuese të Shqipërisë: "Detyrimi për të garantuar të drejtën efektive të aksesit në gjykatë nuk nënkupton thjesht mungesën e një ndërhyrjeje, por mund të kërkojë edhe ndërmarrjen e veprimeve pozitive nga ana e shtetit. Në rast se mohohet një e drejtë e tillë, procesi konsiderohet jo i rregullt, sepse aksesi në gjykatë është para së gjithash një kusht kryesor për të realizuar mbrojtjen e të drejtave të tjera. Shteti i së drejtës nuk mund të konceptohet pa u njohur individëve të drejtën dhe mundësinë për t’iu drejtuar gjykatës"[3]

E drejta për ndihmë juridike të garantuar nga shteti është parashikuar shprehimisht në shumë akte në fuqi në Republikën e Shqipërisë të cilat kanë paraqitur detyrimin ndaj shtetit shqiptar për të miratuar Ligjin nr. 111/2017 me objektin përkatës të përcaktuar në nenin 1 të tij. Kështu, Kushtetuta e Republikës së Shqipërisë në nenin 31 dhe nenin 15, pika 2, parashikon respektivisht: “Gjatë procesit penal kushdo ka të drejtë: ... c) të ketë ndihmën pa pagesë të një përkthyesi, kur nuk flet ose nuk kupton gjuhën shqipe; ç) të mbrohet vetë ose me ndihmën e një mbrojtësi ligjor të zgjedhur prej tij; të komunikojë lirisht dhe privatisht me të, si dhe t’i sigurohet mbrojtja falas, kur nuk ka mjete të mjaftueshme; ...” dhe “Organet e pushtetit publik, në përmbushje të detyrave të tyre, duhet të respektojnë të drejtat dhe liritë themelore të njeriut, si dhe të kontribuojnë në realizimin e tyre”. Po kështu, Vendimi i Gjykatës Kushtetuese nr.7 datë 27.02.2013 parashikon: “Mohimi i të drejtës për t’iu drejtuar gjykatës dhe për të marrë një përgjigje përfundimtare prej saj për pretendimet e ngritura, përbën cenim të së drejtës themelore për një proces të rregullt ligjor”.

Me tej, Konventa Evropiane e të Drejtave të Njeriut (KEDNJ) në nenin 6 të saj që ka të bëjё me “Të drejtën për një proces të rregullt ligjor”, në pikën 3, parashikon: “3. Çdo i akuzuar për një vepër penale ka të drejtat minimale të mëposhtme: ... c. të mbrohet vetë ose të ndihmohet nga një mbrojtës i zgjedhur prej tij, ose në qoftë se ai nuk ka mjete të mjaftueshme për të shpërblyer mbrojtësin, t’i mundësohet ndihma ligjore falas kur këtë e kërkojnë interesat e drejtësisë; e. të ndihmohet falas nga një përkthyes në qoftë se nuk kupton ose nuk flet gjuhën e përdorur në gjyq”. Bazuar në jurisprudencën e Gjykatës Evropiane e të Drejtave të Njeriut (GJEDNJ), në cështjen Savitsky kunder Ukrainës, vendoset një standard të ri: GJEDNJ mund të detyrojë shtetin kur është e nevojshme të ofrojë ndihme juridike falas. I njëjti standard parashikohet edhe ne cështjen Airey kunder Irlandёs.

PAKTI NDËRKOMBËTAR PËR TË DREJTAT CIVILE DHE POLITIKE[4], neni 14, pika 3, parashikon: “3. Secili person i akuzuar për njё vepёr penale ka tё drejtё plotësisht të barabartë tё ketё kёto garanci minimale: ... (ç) Tё jetё i pranishёm gjatё procesit dhe tё mbrohet vetё ose nëpërmjet njё mbrojtёsi tё zgjedhur prej tij; nё qoftё se nuk ka mbrojtje, duhet tё informohet pёr tё drejtёn e tij qё tё ketё njё tё tillё dhe, kurdoherё qё e kёrkon interesi i drejtёsisё, atij duhet t'i caktohet njё mbrojtje falas në cilindo rast të tillë nёse ai nuk ka mjete pёr tё paguar;...”

Kodi i Procedurës Penale, nё nenin 1 dhe në nenin 6, parashikon: “Neni 6 Sigurimi i mbrojtjes 1. I pandehuri ka të drejtë të mbrohet vetë ose me ndihmën e mbrojtësit. Kur nuk ka mjete të mjaftueshme i sigurohet mbrojtja falas me avokat në rastet e parashikuara nga ky Kod. 2. Mbrojtësi ndihmon të pandehurin që t’i garantohen të drejtat procedurale dhe t’i ruhen interesat e tij ligjore”. Kodi i Procedurës Civile, neni 23, parashikon: “Palët janë të lira të ndërtojnë mbrojtjen e interesave të tyre në gjykim, nëpërmjet përfaqësimit ose të çdo ndihme tjetër juridike, në përputhje me dispozitat në fuqi”.

Bazuar në kërkesat e mësipërme të parashikuara nga legjislacioni shqiptar në lidhje me ndihmën juridike, nga data 1 qershor 2018, ka hyrë në fuqi Ligji nr.111/2017 “Për ndihmën juridike të garantuar nga shteti”. Ky ligj sanksionon procedurat për përfitimin e ndihmës juridike falas dhe të garantuar nga shteti, në formën e ndihmës juridike parësore (dhënia e informacioneve dhe këshillimit ligjor), ose të ndihmës juridike dytësore (dhënia e ndihmës juridike dhe ofrimi i mbrojtjes para gjykatës). Ky ligj, gjithashtu, ka parashikuar krijimin e një strukture të posaçme brenda Ministrisë së Drejtësisë, që ështё Drejtoria e Ndihmës Juridike Falas, strukturë e cila administron, koordinon dhe identifikon nevojat për ndryshime dhe përmirësime në sistemin e ofrimit të ndihmës juridike falas[1].

Në kushtet që objekti i ligjit është përcaktuar me qëllim mbrojtjen e interesave themelore dhe ligjore të individëve dhe interesit të drejtësisë, vlen të përmendet se GJEDNJ ka pasuruar me vendimet e saj kuptimin dhe interpretimin e ‘interesit të drejtësisë’, dhe për qëllime të zbatimit të Ligjit të Ndihmës Juridike është e rëndësishme që ligji të zbatohet në lidhje dhe në përputhje me këtë jurisprudencë. Pa kaluar në shumë hollësi, këtu përmendim se interesi i drejtësisë përmendet dhe në cështjen Krylov kundёr Rusisë, në të cilën GJEDNJ citon “... për qëllime të procesit të rregullt, interesi i drejtësisë do t’i nënshtrohet një testi i cili konsiston në tre pika: 1-kompetencat e gjykatave; 2-serioziteti i akuzave; dhe 3-ashpërsia e dënimit...”

Organizimi dhe administrimi i ndihmës juridike të garantuar nga shteti është në objektin e Ligjit nr.111/2017, ndërkohë që deri tani “shumica dërrmuese e çështjeve të ndihmës juridike që përfshijnë grupe të cënueshme ende trajtohen nga grupe të shoqërisë civile me mbështetje të donatorëve”[2] dhe “Pavarësisht të drejtës ligjore për ndihmë ligjore falas në çështje civile, organizatat jofitimprurese raportuan se shumë pak individë përfituan prej saj gjatë vitit”[3].

Për qëllime të analizës së objektit të Ligjit nr. 111/2017, referuar në përkufizimin e “Ndihmë juridike dytësore” është e rëndësishme të mbahet në vëmendje se ky ligj mbulon shërbimin juridik që ofrohet në çështjet penale, për të cilat zbatohet mbrojtja e detyrueshme, sipas përcaktimeve të legjislacionit procedural penal. “Mbrotja kryesisht” duhet të shihet si aspekt të ndihmës juridike, veçanërisht, në fushën e organizimit, kushteve që duhet të plotësojë mbrojtësi, specializimet, etj.
