Kategoritë e veçanta të përfituesve të ndihmës juridike
Ndihma juridike i ofrohet personave të mëposhtëm, pavarësisht të ardhurave dhe pasurisë së tyre:
- viktimave të dhunës në familje;
- viktimave të abuzuar seksualisht dhe viktimave të trafikimit të qenieve njerëzore, në çdo fazë të procedimit penal;
- viktimave të mitur dhe të miturve në konflikt me ligjin, në çdo fazë të procedimit penal;
ç) fëmijëve, të cilët jetojnë në institucionet e përkujdesjes shoqërore;
fëmijëve nën kujdestari, të cilët kërkojnë të nisin një proces pa miratimin e kujdestarit të tyre ligjor ose kundër kujdestarit të tyre ligjor;
dh) personave që përfitojnë nga pagesa për aftësinë e kufizuar, në përputhje me legjislacionin në fuqi për ndihmën dhe shërbimet shoqërore, duke përfshirë edhe personat që përfitojnë nga statusi i të verbrit;
personave, të cilët i nënshtrohen trajtimit të pavullnetshëm në institucionet e shërbimit të shëndetit mendor, sipas dispozitave të legjislacionit në fuqi për shëndetin mendor;
ë) personave, të cilët i nënshtrohen trajtimit vullnetar në institucionet e shërbimit të shëndetit mendor për sëmundjet e rënda mendore;
personave, ndaj të cilëve kërkohet heqja ose kufizimi i zotësisë për të vepruar, në çdo fazë të këtij procesi;
personave, të cilëve u është hequr ose kufizuar zotësia për të vepruar, që kërkojnë të nisin një proces kundër kujdestarit të tyre ligjor, për rifitimin e zotësisë për të vepruar, pa miratimin e kujdestarit ligjor;
gj) personave, të cilët janë përfitues të skemave të mbrojtjes sociale;
personave, të cilëve u është cenuar e drejta nëpërmjet një veprimi ose mosveprimi që përbën diskriminim, bazuar në vendimin e organit kompetent, sipas legjislacionit në fuqi për mbrojtjen nga diskriminimi.
Për të drejtat procedurale, Ligji “Për Ndihmën Juridike” zgjeron kategorinë e personave që përfitojnë ndihmë juridike dhe prezanton konceptet e ndihmës juridike parësore dhe dytësore[1].
Ky nen përcakton përfituesit e ndihmës juridike, të cilët janë përfitues pavarësisht të ardhurave dhe pasurisë së tyre. Këta përfitues kategorizohen si kategori e veçantë për shkak të cilësisë së tyre. Nga pikëpamja e kategorisë përfituese, Ligji nr. 111/2017 sanksionon qartësisht dhe kodifikon kategoritë përfituese, duke e zgjeruar rrethin e tyre, me kategoritë e veçanta të përfituesve, pavarësisht të ardhurave dhe pasurive[2], si: viktima të dhunës në familje, viktima të abuzuar seksualisht, dhe viktima të trafikimi të qenieve njerëzore në çdo faze procedimi penal, viktima të mitur dhe të miturve në konflikt me ligjin, në çdo fazë të procedimit penal, fëmijët që jetojnë në institucione të përkujdesit shëndetësor, fëmijët nën kujdestari kur duan të nisin veprime kundër kujdestarit, ose pa pëlqimin e tij, personat që përfitojnë nga pagesa për aftësinë e kufizuar, personat që i nënshtrohen trajtimit të pavullnetshëm në institucionet e shërbimit mendor, personat të cilët i nënshtrohen vullnetarisht trajtimit për sëmundje të rënda mendore, personat ndaj të cilëve kërkohet heqja ose kufizimi i zotësisë për të vepruar, personat të cilët janë përfitues të skemave të mbrojtjes sociale, personat të cilat janë diskriminuar, i provuar ky cenim përmes vendimi të Komisionerit për Mbrojtjen nga Diskriminimi.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘a’, pra, viktimave të dhunës në familje, është e rëndësishme të referohemi në përkufizimet e Ligjit nr. 9669[3] datë 18.12.2006 “Për masa kundër dhunës në marrëdhëniet familjare”, i ndryshuar me Ligjin nr. 47/2018. Sipas këtij ligji, “viktimë” është personi mbi të cilin është ushtruar dhuna e përcaktuar në pikën 1 të nenit 3: “1. “Dhunë” është çdo veprim ose mosveprim i një personi ndaj një personi tjetër, që sjell si pasojë cënim të integritetit fizik, moral, psikologjik, seksual, social, ekonomik”.
Përkufizimet dhe parashikimet e mëposhtme ndihmojnë për identifikimin me të saktë të kësaj kategorie të veçantë: Neni 3, pika 2: “Dhunë në familje” është çdo akt dhune, i përcaktuar si pas pikës 1, të këtij neni, që ndodh brenda familjes ose njësisë shtëpiake, e ushtruar ndërmjet pjesëtarëve të familjes, të përcaktuar në pikën 7, të këtij neni, që janë ose kanë qenë në marrëdhënie familjare, pavarësisht nga fakti nëse dhunuesin ose ka ndarë të njëjtën banesë me viktimën”. Neni 3, pika 7, parashikon: “Pjesëtarë të familjes” janë: a) bashkëshorti/ja ose bashkëjetuesi/ja apo ish-bashkëshorti/ja apo ish-partneri/ja bashkëjetues; b) vëllezërit, motrat, përfshirë, sipas rastit, edhe bashkëshortin/en ose bashkëjetuesin/en e tyre, si dhe nipin e mbesën, nëse këta të fundit janë anëtarë të njësisë shtëpiake; c) paraardhësit dhe pasardhësit në vijë të drejtë, pa kufizime, përfshirë edhe rastet kur kjo marrëdhënie krijohet nëpërmjet birësimit; ç) prindërit e bashkëshortit/es ose të bashkëjetuesit/es, përfshirë dhe thjeshtrin/thjeshtrën, edhe sikur kjo lidhje të burojë nga birësimi; d) gjinia në vijë të drejtë, përfshirë edhe prindërit, edhe fëmijët e birësuar të bashkëshortit/es ose bashkëjetuesit/es; dh) vëllezërit dhe motrat e bashkëshortit, bashkëshortes, bashkëjetuesit/es; e) fëmijët e bashkëshortëve ose partnerëve bashkëjetues; ë) personat, të cilët janë ose kanë qenë në marrëdhënie intime, jo domosdoshmërisht të shoqëruar me bashkëjetesë, gëzojnë të njëjtën mbrojtje; f) kujdestari dhe personi që ndodhet në kujdesin e tij gjatë kohës që vazhdon kujdestaria, sipas përcaktimeve të kujdestarisë mbi të miturit dhe kujdestarisë për personat me aftësi të kufizuar dhe personit që i është hequr ose kufizuar zotësia për të vepruar sipas dispozitave të Kodit të Familjes”.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘b’, pra, viktimave të abuzuar seksualisht dhe viktimave të trafikimit të qenieve njerëzore, në çdo fazë të procedimit penal, është e rëndësishme që para së gjithash të referohemi neneve përkatëse të Kodit Penal (nenet në Kreun II, Seksioni VI ‘Krime seksuale', dhe nenet 110/a dhe 128/b) dhe Kodit të Procedurës Penale (neni 58, 58/a, 58/b) ku lexohen elemente që mund të përdoren për të përkufizuar kategoritë e viktimës së abuzuar seksualisht dhe viktimës së trafikimit të qenies njerëzore. Për të identifikuar sa më mirë kategorinë e viktimave të trafikimit të qenies njerëzore është e rëndësishme të referohemi edhe nenit 4 të Konventës së Këshillit të Europës për masat kundër trafikimit të qenieve njerëzore, ratifikuar me Ligjin nr.9642, datë 20.11.2006, ku lexojmë këtë përkufizim: "Viktimë" do të nënkuptojë çdo person fizik që është objekt i trafikimit të qenieve njerëzore, siç përcaktohet në këtë nen". Konsultimi i sa më sipër do të lehtësojë identifikimin e këtyre grupeve për efekte të përfitimit të ndihmës juridike.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘c’, pra, viktimave të mitur dhe të miturve në konflikt me ligjin, në çdo fazë të procedimit penal, duhet të referohemi në përkufizimin e Kodit Civil, neni 9: “I mituri me moshë katërmbëdhjetë vjeç deri në tetëmbëdhjetë vjeç, i cili është i pazoti të kujdeset për punën e tij për shkak sëmundjesh psikike ose zhvillimi të metë mendor, mund t’i hiqet zotësia për të kryer veprime juridike me vendim të gjykatës. Këto veprime mund të kryhen vetëm nëpërmjet përfaqësuesit të tij ligjor”. E rëndësishme është edhe konsultimi me Ligjin nr.37/2017 “Kodi i drejtësisë penale për të mitur”, ku neni 3 përkufizon termin “I mitur në konflikt me ligjin”[4] (shih më poshtë për përkufizimin përkatës).
Në lidhje me kategoritë e veçanta të përcaktuara në pikat a, b, c, të nenit 11 kur janë viktima të veprave penale vlen të përmendet se e drejta për ndihmë juridike, krahas të drejtave të tjera, rrjedh edhe nga dispozitat përkatëse të Kodit të Procedurës Penale: Neni 58 ‘Të drejtat e viktimës së veprës penale’ parashikon: “1. Viktima e veprës penale ka të drejtë: ... b) të përfitojë kujdes mjekësor, ndihmë psikologjike, këshillim dhe shërbime të tjera të ofruara nga autoritetet, organizatat ose institucionet përgjegjëse për ndihmën ndaj viktimave të veprës penale; ... ç) të zgjedhë mbrojtës dhe, kur është rasti, të përfitojë ndihmë juridike falas, sipas legjislacionit në fuqi; ... gj) të përjashtohet, në kushte të caktuara me ligj, nga pagimi i çdo shpenzimi për marrjen e akteve dhe tarife gjyqësore për paraqitjen e kërkesë-padisë që lidhen me statusin e viktimës së veprës penale; ... i) të dëgjohet nga gjykata, edhe kur asnjëra nga palët nuk ka kërkuar thirrjen e saj si dëshmitar, etj.”
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11, pika ‘g’ dhe ‘h’, pra, personave, të cilët i nënshtrohen trajtimit të pavullnetshëm në institucionet e shërbimit të shëndetit mendor, sipas dispozitave të legjislacionit në fuqi për shëndetin mendor, dhe personave të cilët i nënshtrohen trajtimit vullnetar në institucionet e shërbimit të shëndetit mendor për sëmundjet e rënda mendore, duhet të referohemi në përkufizimet përkatëse të parashikuara në Ligj nr.44/2012 “Për shëndetin mendor” dhe Kodin e Procedurës Penale.
Ligj nr. 44/2012 “Për shendetin mendor”, neni 3 përkufizon si më poshtë: “… 10. "Trajtim i vullnetshëm" është trajtimi me kërkesë ose miratim të personit që vuan rregullime të shëndetit mendor ose me kërkesë të përfaqësuesit ligjor të të miturit nën moshën 14 vjeç[5]. 11. "Trajtim i pavullnetshëm[6]" është trajtimi i një personi që vuan nga një çrregullim serioz i shëndetit mendor, që kryhet pa miratimin e tij dhe konfirmohet nëpërmjet një vendimi gjyqësor”.
Ligji nr.7905, datë 21.3.1995 “Kodi i Procedurës Penale i Republikës së Shqipërisë”, i ndryshuar, neni 46 ‘Masat mjekësore të detyrueshme’ parashikon: “1. Në çdo rast kur gjendja mendore e të pandehurit tregon se ai duhet të kurohet, gjykata, vendos, edhe kryesisht shtrimin e të pandehurit në një institucion psikiatrik. 2. Kur është vendosur ose duhet vendosur masa mjekësore e detyrueshme për të pandehurin, gjykata urdhëron që i pandehuri të ruhet në një institucion psikiatrik. 3. Gjatë hetimeve paraprake, prokurori i kërkon gjykatës të vendosë për shtrimin e të pandehurit në një institucion psikiatrik dhe kur vonesa paraqet rrezik, urdhëron shtrimin e përkohshëm deri në marrjen e vendimit nga gjykata”.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘i’, pra personave, ndaj të cilëve kërkohet heqja ose kufizimi i zotësisë për të vepruar, në çdo fazë të këtij procesi, duhet të referohemi në përkufizimin e Kodit Civil Neni 10 i cili parashikon se “Personit madhor, që për shkak sëmundje psikike ose zhvillimi të metë mendor, është tërësisht ose pjesërisht i pazoti të kujdeset për punët e tij, mund t’i hiqet ose kufizohet zotësia për të kryer veprime juridike me vendim të gjykatës”.
Në lidhje me përfituesit e ndihmës juridike për kategoritë e veçantë të përfituesve tëpërcaktuar në nenin 11, pika ‘c’, ‘d’, ‘e’, pra, viktimave të mitur dhe të miturve në konflikt me ligjin, në çdo fazë të procedimit penal; fëmijëve, të cilët jetojnë në institucionet e përkujdesjes shoqërore; fëmijëve nën kujdestari, të cilët kërkojnë të nisin një proces pa miratimin e kujdestarit të tyre ligjor ose kundër kujdestarit të tyre ligjor; duhet të referohemi në përkufizimet dhe parashikimet e Ligjit nr.37/2017 “Kodi i drejtësisë penale për të mitur”. Neni 3 parashikon se “I mitur në konflikt me ligjin” është çdo person që ka mbushur moshën e përgjegjësisë penale deri nën moshën 18 vjeç, ndaj të cilit ekziston një dyshim i arsyeshëm se ka kryer një vepër penale, është marrë si i pandehur dhe/ose është dënuar me vendim gjyqësor të formës së prerë për kryerjen e një vepre penale. Me tej, ky nen perkufizon “I mitur viktimë” është çdo person nën moshën 18 vjeç, të cilit i është shkaktuar dëm moral, fizik ose material, si pasojë e një vepre penale.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘f’, personave që përfitojnë nga pagesa për aftësinë e kufizuar[7], në përputhje me legjislacionin në fuqi për ndihmën dhe shërbimet shoqërore, duke përfshirë edhe personat që përfitojnë nga statusi i të verbrit, duhet të referohemi veçanërisht në përkufizimet dhe parashikimet e Ligjit nr.7703, datë 11.05.1993 “Për sigurimet shoqërore në Republikën e Shqipërisë”[8], Ligjit 57/2019 “Për asistencën sociale” dhe Ligjin nr.8098, datë 28.3.1996 “Për statusin e të verbrit"[9] për të identifikuar nga pikëpamja strikte ligjore grupet përkatëse për përfitim nga ndihma juridike falas:
Ligji nr.7703, datë 11.05.1993 “Për sigurimet shoqërore në Republikën e Shqipërisë”, neni 2 parashikon: “Sigurimi shoqëror i detyrueshëm është jofitimprurës, që mbron me të ardhura: a) Personat e punësuar në lidhje me: invaliditetin, aksidentin në punë dhe sëmundjet profesionale, ; b) personat e tjerë ekonomik aktivë (punëdhënësi dhe të vetëpunësuarit), në lidhje me … invaliditetin dhe….
Ligji 57/2019 “Për asistencën sociale”: Neni 2 “Ky ligj ka për qëllim: a) të përcaktojë ndihmën ekonomike dhe përfitimet për shkak të aftësisë së kufizuar për individët dhe familjet në nevojë, të cilët nuk mund të sigurojnë plotësimin e nevojave bazë jetike, zhvillimin e aftësive e të mundësive personale, ruajtjen e integritetit dhe përfshirjen shoqërore për shkak të aftësive dhe mundësive të kufizuara ekonomike, fizike, psikologjike e shoqërore; b) të zbusë varfërinë dhe përjashtimin shoqëror për individët e familjet, si dhe të krijojë mundësi për integrimin e tyre, nëpërmjet sigurimit të një sistemi ndërhyrjesh e shërbimesh për përmirësimin e jetesës së tyre; c) të garantojë asistencë sociale nëpërmjet ndihmës së menjëhershme financiare për foshnjat e porsalindura; ç) mirorganizimin dhe mirëfunksionimin e institucioneve shtetërore përgjegjëse për ofrimin dhe administrimin e asistencës sociale”. Neni 3 parashikon: “Fusha e zbatimit: Ky ligj zbatohet për individët, familjet në nevojë, personat me aftësi të kufizuara në Republikën e Shqipërisë dhe nënat me foshnja të porsalindura, për ofrimin dhe garantimin e asistencës sociale.”
Ligji nr.8098 datë 28.3.1996 “Për statusin e të verbrit", neni 1, parashikon:
“Përfitojnë nga ky ligj të gjithë personat me mungesë të plotë ose të pjesshëm shikimi, të lindur ose të fituar, të cilët sipas kritereve mjekësore janë të paaftë për punë në kushte normale.”
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘k’, pra, personave, të cilët janë përfitues të skemave të mbrojtjes sociale, duhet të referohemi në parashikimet përkatëse të Ligjit nr.7703, datë 11.05.1993 “Për sigurimet shoqërore në Republikën e Shqipërisë”[10] dhe Ligji nr. 57/2019 “Për asistencën sociale”:
Ligji nr.7703, datë 11.05.1993 “Për sigurimet shoqërore në Republikën e Shqipërisë”, neni 2 parashikon: “Sigurimi shoqëror i detyrueshëm është jofitimprurës, që mbron me të ardhura: a) Personat e punësuar në lidhje me: paaftësinë e përkohëshme në punë për shkak të sëmundjes, barrëlindjen, pleqërinë, invaliditetin dhe humbjen e mbajtësit të familjes, aksidentin në punë dhe sëmundjet profesionale, papunësinë; b) personat e tjerë ekonomikisht aktivë (punëdhënësi dhe të vetëpunësuarit), në lidhje me barrëlindjen, pleqërinë, invaliditetin dhe humbjen e mbajtësit të familjes.
Ligji nr.57/2019 “Për asistencën sociale”: neni 2 “Ky ligj ka për qëllim: a) të përcaktojë ndihmën ekonomike dhe përfitimet për shkak të aftësisë së kufizuar për individët dhe familjet në nevojë, të cilët nuk mund të sigurojnë plotësimin e nevojave bazë jetike, zhvillimin e aftësive e të mundësive personale, ruajtjen e integritetit dhe përfshirjen shoqërore për shkak të aftësive dhe mundësive të kufizuara ekonomike, fizike, psikologjike e shoqërore; b) të zbusë varfërinë dhe përjashtimin shoqëror për individët e familjet, si dhe të krijojë mundësi për integrimin e tyre, nëpërmjet sigurimit të një sistemi ndërhyrjesh e shërbimesh për përmirësimin e jetesës së tyre; c) të garantojë asistencë sociale nëpërmjet ndihmës së menjëhershme financiare për foshnjat e porsalindura; ç) mir organizimin dhe mirëfunksionimin e institucioneve shtetërore përgjegjëse për ofrimin dhe administrimin e asistencës sociale”. Neni 3 parashikon: “Fusha e zbatimit. Ky ligj zbatohet për individët, familjet në nevojë, personat me aftësi të kufizuara në Republikën e Shqipërisë dhe nënat me foshnja të porsalindura, për ofrimin dhe garantimin e asistencës sociale.”
Në lidhje me provueshmërinë e faktit që personi aplikant për ndihmë juridike plotëson kushtet përkatëse (shih më sipër kushtet dhe kërkesat për përfituesit e ndihmës ligjore sipas këtij neni), kërkesa e ofruesit të ndihmës juridike për aktet përkatëse administrative, vendimet gjyqësore, dhe dokumentet e tjera përkatëse, legjitimohen nga nevoja për të provuar përmbushjen e kërkesave dhe kritereve ligjore të përzgjeshmërisë, krahas plotësimit të formularёve, etj., përkatës.
Në lidhje me përfituesit e ndihmës juridike për kategorinë e veçantë të përfituesve të përcaktuar në nenin 11 pika ‘l’, pra, personave, të cilëve u është cenuar e drejta nëpërmjet një veprimi ose mosveprimi që përbën diskriminim, bazuar në vendimin e organit kompetent, sipas legjislacionit në fuqi për mbrojtjen nga diskriminimi, duhet të referohemi në parashikimet e Ligjit nr. 10221 datë 4.2.2010 “Për mbrojtjen nga diskriminimi” dhe konventat përkatëse të ratifikuara nga Republika e Shqipërisë. Kështu, as Ligji nr. 10221, as Konventa ndërkombëtare për eleminimin e të gjitha formave të diskriminimit racial (ratifikuar nga Shqipëria në vitin 1994) dhe as Konventa mbi eleminimin e të gjitha formave të diskriminimit ndaj grave, nuk bëjnë përkufizim të personit subjekt i diskriminimit. Megjithatë, përkatësisht nga objekti dhe përmbajtja e Ligjit nr. 10221/2010 dhe e konventave përkatëse[11] identifikojmë elementet e rëndësishëm për përkufizimin për qëllime të Ligjit nr. 111/2017 të personave të cilëve u është cënuar e drejta nëpërmjet një veprimi ose mosveprimi që përbën diskriminim.
Në lidhje me provueshmërinë e faktit që personi ka qenë subjekt i diskriminuar, është e rëndësishme të marrim në vlerësim që pika 10 e nenit 33 të Ligjit nr. 10221/2010 parashikon se Komisioneri shprehet me vendim dhe se ky vendim është një akt administrativ që konstaton diskriminimin dhe vendos një masë gjobe për shkelësin. Neni 34 i këtij ligji parashikon se subjekti shkelës ka të drejtën e ankimit në gjykatën e shkallës së parë, por, pavarësisht nga kjo e drejtë, për qëllime të Ligjit nr. 111/2017, për te përfituar ndihmë juridike, personi kërkues mund të konsiderohet person që i është cënuar e drejta për shkak të një veprimi ose mosveprimi që përbën diskriminim, veçanërisht, pasi ka dalë një vendim nga Komisioneri përkatës. E rëndësishme për qëllim të kësaj kategorie është që konsiderohen si persona që plotësojnë kushtet e përzgjedhshmërisë ata të cilët janë të konfirmuar si viktima të diskriminimit nga Komisionieri kundër Diskriminimit.
