Kërkesa dhe procedura e dhënies së ndihmës juridike parësore
Kërkesa për dhënien e ndihmës juridike parësorë bëhet me gojë ose me shkrim nga personi i interesuar pranë një qendre shërbimi për ndihmë juridike parësore ose një organizate jofitimprurëse të autorizuar.
Personi, i cili kërkon të përfitojë ndihmën juridike parësore, sipas pikës 1, të këtij neni, duhet të nënshkruajë një vetëdeklarim se përmbush kriteret e përcaktuara në këtë ligj, sipas formularit të vetëdeklarimit të miratuar nga Ministri i Drejtësisë, të shoqëruar me dokumentacionin justifikues. Lista e dokumenteve që shërbejnë për vërtetimin e përmbushjes së kritereve përcaktohet me urdhër të Ministrit të Drejtësisë.
Ndihma juridike parësore ofrohet menjëherë me marrjen e kërkesës. Në rast se dhënia e menjëhershme e ndihmës juridike parësore është e pamundur, personi informohet menjëherë për datën dhe kohën e dhënies së shërbimit të kërkuar.
Një person ka të drejtën të marrë shërbimet e ndihmës juridike parësore për të njëjtën problematikë ose çështje vetëm një herë, me përjashtim të rasteve kur rrethana të reja të caktuara justifikojnë dhënien e shërbimeve të mëtejshme të ndihmës juridike parësore për të njëjtin person, rreth së njëjtës problematikë ose çështje.
Në rast se gjatë dhënies së shërbimeve të ndihmës juridike parësore konstatohet një konflikt interesi, ky shërbim ndërpritet menjëherë. Në rastin kur ndihma juridike parësore jepet nga një qendër shërbimi për ndihmë juridike parësore, çështja trajtohet në përputhje me parashikimet e Kodit të Procedurave Administrative, për shmangien e konfliktit të interesit. Në rastin kur ndihma juridike parësore jepet nga një organizatë jofitimprurëse e autorizuar, kjo e fundit merr masa për shmangien e konfliktit të interesit, sipas dispozitave ligjore në fuqi, duke siguruar dhënien e shërbimeve të ndihmës juridike parësore për kërkuesin.
Në rast se gjatë dhënies së shërbimeve të ndihmës juridike parësore konstatohet se ekziston nevoja për dhënien e shërbimeve të ndihmës juridike dytësore, personi informohet menjëherë për kushtet e dhënies së ndihmës juridike dytësore dhe ndihmohet për plotësimin e kërkesës për dhënien e ndihmës juridike dytësore.
Gjatë ofrimit të shërbimeve të ndihmës juridike parësore mbahet një procesverbal, i cili përmban:
- emrin, mbiemrin dhe numrin e identifikimit personal të kërkuesit;
- adresën e vendbanimit, të dhënat e kontaktit, gjendjen familjare, statusin e punësimit të kërkuesit;
- një përshkrim të shkurtër të problematikës ose çështjes për të cilën janë kërkuar shërbimet e ndihmës juridike parësore;
ç) nëse është e mundur, kohëzgjatjen e takimit ose takimeve;
një përshkrim të shkurtër të dhënies së shërbimit të ndihmës juridike parësore dhe rezultatin e këtij shërbimi;
dh) deklarimi se kërkuesi nuk ka përfituar më parë ndihmë juridike parësore për të njëjtën problematikë ose çështje;
të dhëna të tjera, sipas formularit të miratuar nga Ministri i Drejtësisë.
8. Ruajtja dhe përpunimi i të dhënave personale të kërkuesve të ndihmës juridike parësore bëhet në përputhje me legjislacionin në fuqi për mbrojtjen e të dhënave personale.
Neni 17 i Ligjt nr. 111/2017 parashikon mbi procedurën për t’u ndjekur nga kërkuesi i ndihmës juridike për të përfituar nga ndihma juridike parësore. Sipas dispozitës, kërkesa për dhënien e ndihmës juridike parësorë bëhet me gojë ose me shkrim nga personi i interesuar pranë një operatori të ndihmës juridike parësore. Formalizimi i kërkesës, pavarësisht nëse është bërë me gojë apo me shkrim ndiqet me kërkesën dhe deklaratën përkatëse dhe regjistrimet në procesverbalin e hartuar sipas kërkesave të pikës 7 të nenit 17 (shih më poshtë shpjegimet përkatëse).
Formalizmi i kërkesës dhe dhënies së shërbimit të ndihmës juridike parësore, në fillim dhe gjatë procesit të dhënies së ndihmës juridike, është i rëndësishëm për qëllime të pasqyrimit të punës së kryer nga operatorët përkatës dhe për efekte të llogaridhënies para Drejtorisë së Ndihmës Juridike Falas. Mbi të gjitha, ai është i rëndësishëm për sigurinë mbi identitetin e subjektit kërkues dhe identifikimin nëse ai ka marrë më parë ndihme, dhe regjistrimin e çështjes, kohëzgjatjes së takimeve dhe rezultatet e çdo takimi janë të rëndësishme për strategjinë e çështjes dhe, kur është e nevojshme, për kalimin e një çështje lehtësisht nga një punonjës i ndihmës juridike në një punonjës tjetër, për të mos shkaktuar vonesa për përfituesin e ndihmës, por edhe për qëllime të llogaridhënies së operatorëve përkatës para subjekteve përfituese të ndihmës juridike falas.
Në faqen zyrtare të Ministrisë së Drejtësisë, janë publikuar aktet nënligjore të miratuara me shtojcat përkatëse, në të cilat gjenden edhe formularët në formën e skanuar. Në veçanti, formulari i kërkesës për ndihmë juridike parësore dhe formulari i vetëdeklarimit për ndihmë juridike parësore janë dy formularët kryesorë që mundësojnë që ndihma juridike parësore e kërkuar të jepet menjëherë, siç përcaktohet në pikën 3 të këtij neni.
Një parim tjetër që sanksionon ky nen në lidhje me ndihmën juridike parësore është se një ndihmë specifike jepet vetëm njëherë, përveçse kur ajo duhet të ndiqet nga shërbime të tjera të ndihmës juridike parësore ose me shërbime të ndihmës juridike dytësore (shih pika 4 e nenit 17).
Pika 5 e këtij neni parashikon mbi rastet kur ndihma juridike parësore jepet nga qendrat shtetërore të ndihmës juridike. Në këtë rast, Kodi i Procedurave Administrative rregullon veprimtarinë e qendrës dhe punën e punonjësve me trajnim të posaçëm dhe është i rëndësishëm për t’u respektuar veçanërisht në lidhje me shmangien e konfliktit të interesit. Në lidhje me detyrimet e organizatave jofitimprurëse që japin ndihmë juridike parësore, krahas ligjit dhe akteve nënligjore përkatëse, kontrata e lidhur midis organizatës përkatëse dhe Drejtorisë së Ndihmës Juridike rregullon detyrimet e organizatës për të respektuar rregullat dhe procedurat në lidhje me kërkesën dhe dhënien e ndihmës juridike parësore.
Pika 8 e nenit parashikon edhe për detyrimin në lidhje me ruajtjen dhe përpunimin e të dhënave personale të kërkuesve të ndihmës juridike parësore sipas legjislacionin në fuqi për mbrojtjen e të dhënave personale, detyrim i cili është i zbatueshem për çdo operator të ndihmës juridike parësore, qoftë qendrat shtetërore të shërbimit apo operatorët privatë të ndihmës juridike parësore.
Aktet nënligjore përkatëse në lidhje me kërkesën dhe dhënien e ndihmës juridike parësore, të cilat janë të rëndësishme, në veçanti për zbatimin e nenit 17, janë si më poshtë:
(i) Urdhëri nr.225, datë 25.03.2019, "Për miratimin e formularëve të ndihmës juridike të garantuar nga shteti":
Shtojca I- formulari i kërkesës për ndihmë juridike parësore;
Shtojca IV- formulari i vetdeklarimit për të ardhurat e pakta;
Shtojca V- formulari i deklarimit për kategoritë e posaçme;
Shtojca VII- formati i regjistrit të organizatave jofitmprurëse që ofrojnë ndihmë juridike parësore.
(ii) Urdhëri nr.226, datë 25.03.2019 “Për miratimin e kontratave të ndihmës juridike të garantuar nga shteti"
me Shtojcën I- kontrata tip me organizatat jofitimprurëse që ofrojnë ndihmë juridike parësore.
